These Terms of Service (“Terms”) govern your use of the Vantage iOS application and related websites, software, features, and services (collectively, the “Service”) provided by On Course Technology LLC (“Vantage,” “we,” “us,” or “our”). By downloading, accessing, creating an account for, purchasing through, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

By downloading, accessing, creating an account for, purchasing through, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Vantage is a golf rangefinder and on-course companion that may provide course maps, GPS yardages, green maps, plays-like distances, shot tracking, scoring, strokes-gained analytics, weather information, course-management integrations, and other golf-related features. Features may vary by course, device, account type, subscription status, geographic area, and software version. We may add, modify, suspend, or discontinue features of the Service at any time.

2. Eligibility and accounts
You must be at least 13 years old to create an account or use the Service independently. If you are under the age of majority where you live, you may use the Service only with the permission of a parent or legal guardian. You are responsible for maintaining the confidentiality and security of your account and for activity occurring through it. You agree to provide accurate information and not to impersonate another person, create accounts for fraudulent purposes, interfere with the Service, attempt to bypass security measures, or use the Service in violation of applicable law. Some functionality may be available without an account through a local guest profile. Guest information may be lost if the app is deleted, app data is cleared, or the device is lost or replaced.

Vantage uses GPS, mapping data, elevation data, course information, device sensors, weather information, and mathematical estimates to provide golf-related information. All distances, positions, boundaries, elevations, green contours, hazards, suggested clubs, plays-like distances, and similar information are estimates. GPS accuracy can be affected by trees, terrain, buildings, atmospheric conditions, device positioning, satellite availability, hardware limitations, and other factors outside our control. Course layouts and conditions can also change without our knowledge. Tees, pins, hazards, cart paths, out-of-bounds areas, temporary greens, construction areas, course restrictions, and other features shown in Vantage may therefore differ from actual conditions. You are responsible for confirming actual course conditions and complying with all posted signs, course rules, staff instructions, and applicable Rules of Golf. Vantage should not be relied upon for navigation where inaccurate location information could create a risk to persons or property.

Plays Like distances, strokes-gained statistics, handicap comparisons, club recommendations, performance estimates, and other analytics are informational tools only. These features may rely on models, historical benchmarks, weather information, elevation data, user-entered information, estimated shot locations, and other data that may contain errors or uncertainty. They are not guarantees of actual golf performance and should be treated as estimates intended to assist your own judgment.
Plays Like distances, strokes-gained statistics, handicap comparisons, club recommendations, performance estimates, and other analytics are informational tools only. These features may rely on models, historical benchmarks, weather information, elevation data, user-entered information, estimated shot locations, and other data that may contain errors or uncertainty. They are not guarantees of actual golf performance and should be treated as estimates intended to assist your own judgment.
5. Course safety and use while playing
You remain responsible for your own safety and for operating any golf cart or other vehicle safely. Do not interact with the Service in a manner that distracts you while driving a golf cart or operating any vehicle. Vantage does not replace course signage, cart restrictions, ranger or staff instructions, weather warnings, emergency alerts, or your own observation of conditions. You should never enter an area solely because the Service appears to show that it is safe or permitted.

6. Premium features and purchases
Certain features may require a paid Vantage Premium subscription, one-time purchase, or other in-app purchase. Premium features may include, among other things, green maps, Plays Like distances, and advanced Strokes Gained analytics. The exact features included with Premium may change as the Service evolves. Prices and available purchase options are displayed before purchase. Purchases made through Apple’s App Store are processed by Apple and are also subject to Apple’s applicable terms and payment policies. Auto-renewable subscriptions: payment will be charged to your Apple Account at confirmation of purchase; the subscription automatically renews unless canceled in accordance with Apple’s subscription-management rules; your Apple Account will be charged for renewal at the applicable price; you can manage or cancel your subscription through your Apple Account subscription settings; and deleting the Vantage app or deleting your Vantage account does not automatically cancel an App Store subscription. You are responsible for canceling a subscription through Apple if you no longer want it to renew. Refund requests for purchases processed through Apple’s App Store are generally handled by Apple under Apple’s applicable refund policies. Promotional, beta, complimentary, founding-member, course-sponsored, or otherwise free Premium access may be modified or discontinued unless we expressly state that the entitlement is permanent. If an account has specifically been granted a lifetime Premium entitlement, that entitlement does not require an active recurring subscription, subject to these Terms and continued availability of the Service.

7. Vantage courses and course-sponsored access
Some golf courses may provide Vantage hardware, Vantage Cart Screens, Premium access, or other Vantage features to golfers. When using Vantage at a participating course, certain information may be used to support course operations. For example, your on-course location may be displayed to authorized course staff for pace-of-play and course-flow management as described in our Privacy Policy. A golf course is independently responsible for its course operations, staff, rules, services, pricing, food and beverage offerings, and other activities. Vantage is not responsible for the acts or omissions of a participating golf course.
Some golf courses may provide Vantage hardware, Vantage Cart Screens, Premium access, or other Vantage features to golfers. When using Vantage at a participating course, certain information may be used to support course operations. For example, your on-course location may be displayed to authorized course staff for pace-of-play and course-flow management as described in our Privacy Policy. A golf course is independently responsible for its course operations, staff, rules, services, pricing, food and beverage offerings, and other activities. Vantage is not responsible for the acts or omissions of a participating golf course.
8. User content
You may be able to submit or store information such as a display name, profile photo, golf statistics, shot information, course adjustments, or other content (“User Content”). You retain ownership of your User Content. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, display, and otherwise use User Content as reasonably necessary to operate, secure, maintain, and improve the Service. You represent that you have the right to provide any User Content you submit and that it does not violate the rights of another person. We may remove User Content that violates these Terms or applicable law.
You may be able to submit or store information such as a display name, profile photo, golf statistics, shot information, course adjustments, or other content (“User Content”). You retain ownership of your User Content. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, display, and otherwise use User Content as reasonably necessary to operate, secure, maintain, and improve the Service. You represent that you have the right to provide any User Content you submit and that it does not violate the rights of another person. We may remove User Content that violates these Terms or applicable law.
9. Course and mapping content
The Service may include maps, imagery, elevation information, weather information, geographic data, course information, and other materials obtained from Vantage, golf courses, public datasets, commercial licensors, users, or third-party providers. Availability and accuracy of this content are not guaranteed. Except for rights expressly granted to you under these Terms, Vantage and its licensors retain all rights in the Service, including its software, design, branding, databases, processed course data, graphics, analytics, and other proprietary materials. You may not scrape, systematically download, reverse engineer, redistribute, resell, reproduce, or create competing datasets from the Service except where applicable law expressly permits such activity.

You may not access or use the Service for an unlawful or fraudulent purpose; interfere with or disrupt the Service or its infrastructure; attempt to gain unauthorized access to another account or system; circumvent authentication, App Attest, subscription verification, access controls, encryption, or other security mechanisms; probe or test the Service for vulnerabilities without our written authorization; use automated tools to scrape or extract substantial portions of the Service; copy or redistribute proprietary course data except as expressly permitted; introduce malware or harmful code; or use the Service in a manner that materially harms Vantage, another user, a golf course, or a third party. We may restrict or terminate access when we reasonably believe these Terms have been violated.

11. Third-party services
The Service may rely upon or interact with third-party products and services, including Apple services, authentication providers, weather providers, mapping or geographic-data providers, and infrastructure providers. We are not responsible for the availability, accuracy, security, or operation of services controlled by third parties. Your use of third-party services may also be governed by their own terms and policies.

We work to keep Vantage available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service may occasionally be unavailable because of maintenance, software updates, network failures, GPS conditions, third-party outages, server problems, course-data issues, or circumstances outside our control. We may change, update, replace, or discontinue any portion of the Service. Where reasonably practical, we will attempt to avoid changes that unnecessarily interfere with an active paid subscription.

We may suspend or terminate an account if we reasonably believe you have violated these Terms, engaged in fraud or abuse, created a security risk, or used the Service in a manner that could harm Vantage, its users, participating courses, or third parties. Sections that by their nature should survive termination, including intellectual-property, disclaimer, liability, and dispute provisions, remain in effect after termination.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” VANTAGE AND ON COURSE TECHNOLOGY LLC DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE WILL ALWAYS BE AVAILABLE, SECURE, ACCURATE, COMPLETE, OR ERROR-FREE. WITHOUT LIMITING THE ABOVE, WE DO NOT GUARANTEE THE ACCURACY OF GPS LOCATIONS, YARDAGES, GREEN MAPS, ELEVATION DATA, COURSE BOUNDARIES, WEATHER INFORMATION, PLAYS-LIKE DISTANCES, STROKES-GAINED CALCULATIONS, OR OTHER ANALYTICAL OUTPUTS. THIS INCLUDES DAMAGES ARISING FROM RELIANCE ON GPS INFORMATION, COURSE MAPS, GREEN MAPS, PLAYS-LIKE CALCULATIONS, WEATHER INFORMATION, ANALYTICS, OR OTHER INFORMATION PROVIDED THROUGH THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF: 1. THE AMOUNT YOU PAID TO VANTAGE FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR 2. US $100. To the extent permitted by law, you agree to indemnify and hold harmless On Course Technology LLC, Vantage, and their members, employees, contractors, and affiliates from claims, losses, liabilities, damages, and reasonable expenses arising from your unlawful use of the Service, your violation of these Terms, or your infringement of another person’s rights. This section does not require you to indemnify Vantage for Vantage’s own unlawful conduct where such an obligation would be prohibited by law.

18. Apple-specific terms
If you downloaded Vantage through Apple’s App Store, you acknowledge that these Terms are between you and On Course Technology LLC, not Apple. Apple is not responsible for providing or maintaining the Service. To the extent required by applicable App Store terms, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce applicable provisions against you. Your use of Vantage must also comply with the applicable App Store and Apple Media Services terms.

Apple is not responsible for providing or maintaining the Service. These Terms and any dispute arising out of or relating to them or the Service will be governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except to the extent the laws of your jurisdiction require otherwise.
